Introduction
Welcome to Exless! These Terms of Service ("Terms") govern your use of the Exless mobile application ("App," "Service," or "Exless"). By creating an account or using the App, you agree to be bound by these Terms.
Please read these Terms carefully before using Exless.
If you do not agree with these Terms, you must not use the App.
1. Acceptance of Terms
By accessing or using Exless, you agree to:
- Comply with these Terms of Service
- Comply with our Privacy Policy
- Comply with all applicable laws and regulations
- Be at least 13 years old (or the age of majority in your jurisdiction)
If you are under 18, you confirm that you have obtained permission from a parent or legal guardian to use the App.
2. Description of Service
What Exless Is:
- A self-help tool for breakup recovery and emotional support
- A safe space to draft messages to an ex without sending them
- An AI-powered coaching feature for 24/7 guidance
- Goal tracking and progress monitoring tools
- SOS intervention features for difficult moments
What Exless Is NOT:
- A substitute for professional mental health care or therapy
- A medical service or medical device
- A crisis intervention hotline
- A platform to contact or communicate with your ex
- A social network or dating service
3. Eligibility & Account Requirements
3.1 Age Requirements
You must be at least 13 years old to use Exless. If you are under 18, you must have parental consent.
3.2 Account Creation
To use Exless, you must:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Not share your account with others
- Not create multiple accounts
3.3 Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Provide false information
- Engage in abusive or harmful behavior
- Attempt to hack or compromise the App
- Use the App for illegal purposes
4. Acceptable Use Policy
4.1 You AGREE to:
- ✓ Use Exless for personal, non-commercial purposes
- ✓ Respect the intellectual property rights of others
- ✓ Provide honest information during onboarding
- ✓ Use the App in accordance with applicable laws
- ✓ Keep your account secure and confidential
4.2 You AGREE NOT to:
- ✗ Use the App to harass, stalk, or threaten anyone
- ✗ Attempt to contact your ex through the App (messages are NOT sent)
- ✗ Share explicit, illegal, or harmful content
- ✗ Reverse engineer, decompile, or hack the App
- ✗ Use automated tools (bots, scrapers) to access the App
- ✗ Impersonate others or create fake accounts
- ✗ Violate any laws or regulations while using the App
- ✗ Use the App if you are a direct competitor (for commercial purposes)
4.3 Consequences of Violation
If you violate this Acceptable Use Policy:
- We may suspend or terminate your account immediately
- We may report illegal activity to law enforcement
- You may be liable for damages caused by your violation
5. Medical & Mental Health Disclaimers
5.1 Not a Substitute for Professional Care
IMPORTANT: Exless is a self-help tool, NOT a medical or mental health service.
- The AI Coach is NOT a licensed therapist, counselor, or medical professional
- Exless does NOT provide medical advice, diagnosis, or treatment
- Exless is NOT intended to replace therapy, medication, or professional care
- Do NOT rely solely on Exless for mental health support
5.2 Crisis Situations
If you are experiencing a mental health crisis:
- Call 988 (Suicide & Crisis Lifeline) in the US
- Call your local emergency number (911 in the US)
- Contact a licensed mental health professional immediately
- Go to your nearest emergency room
Exless is NOT a crisis hotline and cannot provide emergency intervention.
5.3 Limitation on AI Coach
The AI Coach feature:
- Provides general emotional support and guidance
- Uses artificial intelligence (not human therapists)
- May make mistakes or provide incomplete information
- Should NOT be relied upon for medical or psychiatric advice
- Is trained to direct you to professional help in crisis situations
5.4 Your Responsibility
You acknowledge and agree that:
- You are responsible for your own mental health and well-being
- You will seek professional help if needed
- You will not hold Exless liable for mental health outcomes
- You understand the limitations of AI-based support
6. User Content & Data
6.1 Your Content
"Your Content" includes:
- Draft messages you write to your ex
- Conversations with the AI Coach
- Onboarding responses and recovery goals
- Any other text, data, or information you provide
6.2 Ownership
You retain ownership of Your Content. However, by using Exless, you grant us a limited license to:
- Store Your Content on our servers (Firebase/Firestore)
- Process Your Content to provide the Service (e.g., generate AI responses)
- Use anonymized, aggregated data to improve the App
- Comply with legal obligations (e.g., respond to court orders)
6.3 Content Responsibilities
You are solely responsible for Your Content. You agree that:
- Your Content does not violate any laws or third-party rights
- Your Content is not defamatory, harassing, or illegal
- You will not upload malware, viruses, or harmful code
- You have the right to share Your Content with us
7. Intellectual Property Rights
7.1 Exless Ownership
The Exless App, including all:
- Software code and algorithms
- Design, graphics, and user interface
- Logos, trademarks, and branding
- AI Coach prompts and responses (excluding your input)
- Educational content and recovery plans
...are owned by Exless and protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Use the App for personal, non-commercial purposes
- Access features available to your account type
You do NOT have the right to:
- Copy, modify, or distribute the App
- Create derivative works based on the App
- Use Exless trademarks without permission
- Sell or sublicense access to the App
8. Third-Party Services
8.1 Third-Party Integrations
Exless uses third-party services, including:
- Firebase/Firestore (Google) - data storage and authentication
- OpenAI API - AI Coach functionality
- Apple Sign-In / Google Sign-In - optional authentication
Your use of these services is subject to their respective terms and privacy policies.
8.2 Third-Party Liability
We are NOT responsible for:
- The performance or availability of third-party services
- Changes to third-party terms or pricing
- Data breaches or issues caused by third parties
- Actions or omissions of third-party providers
9. Payments & Subscriptions
9.1 Current Pricing
Exless is currently free to use. All core features are available at no cost.
9.2 Future Pricing
We reserve the right to:
- Introduce paid subscriptions or in-app purchases in the future
- Change pricing for new features or premium tiers
- Offer free trials or promotional pricing
10. Disclaimers & Limitation of Liability
10.1 "As-Is" Service
EXLESS IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT:
- The accuracy, reliability, or completeness of the Service
- Uninterrupted or error-free operation
- The results you will achieve using the App
- The suitability of the App for your specific situation
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXLESS AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Loss of data or Content
- Account termination or suspension
- Service interruptions or downtime
- Emotional distress or mental health harm
- Consequential, incidental, or punitive damages
- Any damages arising from reliance on AI Coach advice
Maximum Liability: If we are found liable for any damages, our total liability shall not exceed the amount you paid us in the past 12 months (currently $0, as the App is free).
11. Service Availability & Changes
11.1 Service Availability
We strive to keep Exless available 24/7, but we do NOT guarantee:
- Continuous, uninterrupted access
- Error-free operation
- Compatibility with all devices or operating systems
- Availability in all geographic regions
11.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any features at any time
- Change the design, functionality, or content of the App
- Add or remove features without prior notice
12. Termination & Account Deletion
12.1 Termination by You
You may terminate your account at any time by:
- Going to More → Settings → Account → Delete Account
- Contacting us at exlessapp@gmail.com
When you delete your account:
- All Your Content will be permanently deleted within 30 days
- You will lose access to all features immediately
- Deletion is irreversible - we cannot recover your data
12.2 Termination by Us
We may terminate or suspend your account if:
- You violate these Terms or our Privacy Policy
- You engage in abusive, fraudulent, or illegal activity
- Your account has been inactive for an extended period
- We discontinue the Service entirely
13. Dispute Resolution & Arbitration
13.1 Informal Resolution
Before filing any legal claim, you agree to:
- Contact us at exlessapp@gmail.com to describe the issue
- Attempt to resolve the dispute informally for 30 days
- Provide reasonable information to help us address your concern
13.2 Binding Arbitration (US Users)
If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except:
- Small claims court disputes (under $10,000)
- Intellectual property disputes
- Disputes seeking injunctive relief
Arbitration Rules:
- Arbitration will be conducted by the American Arbitration Association (AAA)
- Arbitration will follow AAA's Consumer Arbitration Rules
- Arbitration will take place in Macomb County, Michigan, United States
- You and Exless will each pay our own arbitration costs for claims under $10,000
13.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to:
- Participate in a class action lawsuit
- Join a collective or representative action
- Consolidate your claim with other users' claims
14. Governing Law & Jurisdiction
14.1 Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.
14.2 Jurisdiction (Non-Arbitration Disputes)
For disputes not subject to arbitration:
- You agree to submit to the exclusive jurisdiction of courts in Macomb County, Michigan
- You waive any objection to venue or inconvenient forum
15. Changes to These Terms
15.1 Right to Modify
We may update these Terms from time to time to reflect:
- Changes in the law or regulations
- Changes to our Service or features
- Security or operational improvements
- Clarifications or corrections
15.2 Notice of Changes
When we update these Terms:
- We will update the "Last Updated" date at the top
- We will notify you via email or in-app notification (for material changes)
- You will be asked to accept the new Terms to continue using the App

- You understand that Exless is not a substitute for professional mental health care
If you do not agree with these Terms, you must not use the App.
